- Although IEBA encourages its Advisors and Staff to engage in a wide variety of activities related to education and research, it respects the legal right to intellectual and creative property in all media. Such educational activities must therefore be performed within the bounds of copyright law.
- IEBA does not support unauthorized duplication or distribution in any form. Advisors who disregard the copyright policy and law are in violation of IEBA policy, do so at their own risk, and assume all liability.
- While IEBA Advisors may refer students to publicly available resources,
IEBA Advisors my not Produce/Copy/Print any third-party educational materials with out permission from the authors.
IEBA Internal Copyright Clearance Procedures
- Advisor/Staff should review the copyright content (if any) of class packets and submit the appropriate form(s) and information to the copyright coordinator
- The copyright coordinator must obtain written permission from the copyright holder before the material can be reproduced and subsequently sold.
- Acquisition of copyright permission is often a complex and time-consuming process; therefore, adequate time should be allowed for processing. Some permissions are granted immediately and others may take up to ten weeks.
Prohibitions and Areas of Caution
- Only IEBA developed course materials maybe systematically duplicated and are sold commercially to IEBA clients.
- IEBA policy does not permit educational materials to be sold directly by the Advisors
- IEBA course materials do not fall under open license or fair use guidelines and Advisors must obtain copyright clearance from IEBA.
- The same rule applies to using third party educational materials. If an Advisor intends to use materials not owned by IEBA, they must first contact IEBA to obtain copyright clearance from the publisher.
- Advisors/staff that utilize copiers or take materials to off-campus vendors for reproduction assume all responsibility and liability for copyright compliance.
- The Berne Convention Act of 1988 qualifies all authored works as being copyrighted and does not required display of the familiar copyright notice. Works distributed after March 1, 1989, do not required copyright notice. As a result, it is necessary to assume that all works are protected by copyright laws unless they are exempted by fair use or are defined as within the public domain.
